Consular Marriages/Divorces (they may not be used for U.S. immigration purposes)
In general, Consular marriages and divorces performed by Royal Thai Consulates abroad are not considered to be valid for U.S. immigration purposes. Marriages and/or divorces obtained at Thai consulates abroad may be recognized by the laws of the host country and in Thailand, but this does not necessarily mean that these marriage and divorce certificates are recognized for U.S. immigration purposes. Birth Certificate Is Not Available
A Thai Beneficiary who lacks his/her Thai Birth Certificate may submit a Certificate of Birthplace from a Thai District Office, a Thai national I.D. card and a Thai Household Registration Book to proof his/her Thai identity. These items may only be submitted in lieu of a birth certificate for immigrant visa cases that do not depend upon evidence of blood ties between a petitioner and a beneficiary. Custody/Consent Policy
For all minors applying for a immigrant visa with a parent or step-parent as the petitioner -- we must ensure that his/her biological mother/father give consent for him/her to emigrate to the U.S. In most circumstances, for a minor who has a Thai parent, the parent can write a statement of consent for the child to emigrate at the U.S. Consulate or his/her local Thai District Office or Thai Consulate (if resides abroad). This statement must include a signed copy of his/her Thai national I.D. card as proof of identity. An example of wordings of a statement of consent is as follows:
(Mr/Miss/Mrs./Ms.) First Name + Last Name) ( First Name + Last Name of child/children)(No. of children)
For a minor who has a non-Thai parent, the parent also needs to submit a statement of consent for the child to emigrate that includes a copy of his/her country I.D. as proof of identity. An example of wordings of a statement of consent is as follows:
My name is ________________________ who is the father / mother of _________________ consent for child / total of no. of children to emigrate to the U.S. permanently without any conditions.
